The Department of Labor and Employment (DOLE) has released official pay guidelines for two upcoming holidays in August: Ninoy Aquino Day on August 21 and National Heroes Day on August 25.

Under Proclamation No. 727, signed by President Ferdinand Marcos Jr. on October 30, 2024, August 21 is declared a special non-working holiday to commemorate the 42nd anniversary of Senator Benigno “Ninoy” Aquino Jr.’s assassination. Meanwhile, August 25 is recognized as a regular holiday to honor the courage and sacrifice of Filipino heroes who fought for the nation’s freedom.
Pay Rules for August 21 (Special Non-Working Holiday)
DOLE reiterated the “no work, no pay” policy for employees who do not report for duty, unless a company policy or collective bargaining agreement provides otherwise.
- If the employee works, they are entitled to an additional 30% of their basic wage for the first eight hours.
- Overtime work beyond eight hours merits an extra 30% of the hourly rate on that day.
- If the special day falls on the employee’s rest day, they should receive an additional 50% of the basic wage for the first eight hours.
- Overtime on a rest day during the special holiday requires another 30% of the hourly rate on that day.
Pay Rules for August 25 (Regular Holiday)
For the regular holiday, DOLE emphasized that employees should receive 100% of their daily wage even if they do not work, as long as they were present or on paid leave on the workday before the holiday.
- If they work on the holiday, they must be paid double the basic wage for the first eight hours.
- Overtime is compensated with an extra 30% of the hourly rate on the holiday.
- If the regular holiday falls on a rest day, workers should receive an additional 30% of the 200% basic wage for the first eight hours.
- Overtime in this situation warrants another 30% of the hourly rate on the day.
DOLE urged employers to strictly follow these rules to protect the rights of workers and avoid disputes. The department also reminded employees to verify their pay slips to ensure proper computation during the two holidays.
