Court Orders Darryl Yap to Remove Materials for Controversial Film

A Muntinlupa Regional Trial Court (RTC) has issued a writ of habeas data against director Darryl Yap, mandating the removal of promotional materials for his upcoming film, “The Rapists of Pepsi Paloma.” The court’s decision came in response to a petition filed by actor and host Vic Sotto, who is mentioned and accused of rape in the film’s teaser.

The RTC Branch 205’s order prohibits Yap from further distributing any promotional content related to the film. It specifically instructs the director to take down all materials already posted on social media and forbids the sharing of these posts.

Sotto’s legal counsel, Atty. Enrique Dela Cruz emphasized that the court’s issuance of the writ of habeas data is a protective measure for his client’s rights. He stated, “The court has issued a writ of habeas data as his right was violated so he was temporarily granted habeas data.” Dela Cruz further urged all parties to cease posting or sharing related content until the matter is resolved.

“The Rapists of Pepsi Paloma” is a biographical crime drama directed by Darryl Yap, focusing on the life of Pepsi Paloma, a Filipino-American actress and dancer who gained fame in the 1980s. The film has sparked controversy due to its sensitive subject matter, particularly the depiction of a 1982 scandal involving Paloma and several entertainment personalities, including Vic Sotto.

Pepsi Paloma, born Delia Dueñas Smith, was a prominent figure in the Philippine entertainment industry during the early 1980s. She was part of a group known as the “soft drink” beauties, alongside Sarsi Emmanuelle and Coca Nicolas. Paloma’s career was marked by both popularity and controversy, notably the 1982 incident where she accused comedians Vic Sotto, Joey de Leon, and Richie D’Horsie of rape. The case was highly publicized, and the accused reportedly issued a public apology. Tragically, Paloma died by suicide in 1985.
