Atty. Mike Feuer has filed a lawsuit against two companies over wage theft.
MIKE FEUER – Attorney Mile Feuer filed a lawsuit against Emelyn Nishi and her companies, Hand Homecare Provide, Inc. and Health Alliance Nurses Corp in Los Angeles.
Based on a recent news report in Inquirer, the caregivers with the Pilipino Workers Center (PWC) have sought the aid of the City Attorney’s Office.
The workers went to the City Attorney’s Office in the pursuit of pushing for their rights and to show the homecare industry that wage theft should be stopped.
Based on the report, a member of the PWC and also a caregiver before, Rufina Tubo, expressed that their hope that the issue would be judged in favor of the workers who are pushing for their rights to be paid and for their dignity.
“We felt vindicated that the city attorney found that there were lots of violations in terms of our wages,” Tubo said.
The former caregiver and PWC member expressed that they were not given salary for their overtime work.
Emelyn Nishi and the two companies are accused of charging between $170 up to $250 daily for 24-hour domestic care but their payment to their workers only range from $100 up to $125 for every shift.
Based on the news report, the lawsuit filed by the Los Angeles City lawyer can lead to million dollars back-wages for the workers.
According to the news report, the alleged wage theft happened since the last four years and around 200 Filipino caregivers are affected.
Based on the lawsuit, the caregivers were forced to manipulate their time records to prevent payments for overtime work.
Moreover, it is stated that the workers were being warned that they may be terminated from their job or blacklisted in the homecare industry.
Based on the news report, the number of households in California that hire domestic workers will not fall below two million.
It is stated that households usually hire workers for nannying or cleaning the house.
