Court Of Appeals Says ‘Go’ To Phaseout 15-Year-Old Buses
Phaseout 15-Year-Old Buses – The Court of Appeals (CA) approves the government’s phasing out of 15-year-old buses, after rejecting a petition questioning two orders setting an age limit on buses.
In a report by Rappler, the 12th Division of the court stood on the ‘constitutionality of Department of Transportation and Communications (DOTC) Order No. 2002-30 that directs the phasing-out of 15-year-old buses, and with the Land Transportation Franchising and Regulatory Board (LTFRB) Resolution No. 2013-001, which also directs the implementation of the order by DOTC.
A petition was filed by the National Confederation of Transport Workers together with other transport groups seeking to prove that the said orders are ‘unconstitutional’ as the latter violates the fair protection of the clause and due process.
But, the Court denied that petition standing with the police power of the government to control public utility vehicles with the purpose of public safety.
In a statement of the CA as quoted in the article, it said that the CA recognizes the goal of transport officials to “establish a modern transport system” that’s is purposed to have a safer and more secure commuting in public.
“The reason is obvious: life is irreplaceable, property is not. When the State’s exercise of police power clashes with a few individuals’ right to property, the former should prevail,” it said as quoted.
In order to minimize the number of vehicular incidents and the like, the court stood to exercise the mandate of the DOTC and LTFRB to achieve an effective implementation of a “rationalized national land transport plan.”
The said ruling was then signed by Associate Justice Maria Elisa Sempio Diy together with Associate Justices Manuel Barrios and Ramon Bato Jr.
