The camp of former Philippine President Rodrigo Duterte has expressed disappointment over the International Criminal Court’s (ICC) decision that found him medically fit to participate in pre-trial proceedings, arguing that the process failed to uphold his right to due process.
The reaction came after the ICC released its findings stating that Duterte is capable of facing the court’s pre-trial phase, based on assessments conducted by medical experts accredited by the tribunal. According to the defense, however, the ruling was reached without allowing them to present independent medical evidence or to question the experts whose opinions were used as the basis for the court’s determination.
Atty. Nicholas Kaufman, a member of Duterte’s legal team, said the defense was frustrated by what it described as procedural limitations imposed by the court. He stressed that the former president’s camp was not allowed to fully participate in the evaluation process, which they believe is a fundamental element of fair judicial proceedings.
“The defense was not allowed to present its own medical findings nor cross-examine the experts relied upon by the court,” Kaufman said, adding that these restrictions undermined Duterte’s right to due process. He emphasized that the issue is not merely about medical fitness but about ensuring that the former leader’s legal rights are respected at every stage of the proceedings.
Kaufman confirmed that the defense plans to file an appeal, challenging the ICC’s findings and the manner in which they were reached. The appeal will argue that procedural fairness was compromised and that the court should have allowed the defense to submit its own medical evidence to provide a more comprehensive assessment of Duterte’s condition.
The ICC, for its part, maintains that its evaluation was conducted in accordance with established procedures and international standards. The court noted that its conclusions were based on professional assessments and were sufficient to determine Duterte’s capacity to participate meaningfully in pre-trial hearings.
The issue of medical fitness has become a key point in the ongoing legal battle, as it directly affects the pace and conduct of the proceedings. Duterte’s camp has repeatedly insisted that health concerns should be carefully and transparently examined, especially given the seriousness of the accusations and the international implications of the case.
