ICC Prosecutor Opposes Duterte’s Request for Interim Release

The Office of the Prosecutor of the International Criminal Court (ICC) has formally opposed the request of former Philippine President Rodrigo Duterte for interim release, citing the risk of witness intimidation, obstruction of justice, and flight.

In a response filed on June 23, the prosecution asserted that Duterte’s continued detention is necessary to ensure his appearance at trial and the integrity of the court proceedings. The document emphasized that Duterte does not recognize the legitimacy of the ICC’s legal process, making his release a serious risk to the case’s progression.

The prosecution argued that Duterte’s political influence, access to international contacts, and substantial financial resources heighten the risk that he may abscond. “He has the means and the network to evade justice if released,” the filing stated.

One of the central concerns raised by the prosecution is Duterte’s alleged ability to interfere with witnesses. Citing his long-standing political power base in Davao City and the ongoing political influence of his children, the prosecution claimed that Duterte and his circle are capable of intimidating witnesses. The document referenced the cases of former senator Leila de Lima and whistleblower Edgar Matobato as examples of past interference.

The prosecution also pointed to Duterte’s controversial statements about his intention to “double” the killings in Davao City should he return to politics, noting that the defense did not deny the authenticity of this statement. The prosecution argued this declaration further supports the need to keep Duterte in detention.

In response to the defense’s claim that Duterte poses no continuing threat, the prosecution said Duterte’s prior threats and public behavior undermine that assertion. It also dismissed the argument for release based on humanitarian grounds, saying such factors alone are insufficient to override the serious risks posed by his release.

Duterte’s legal team filed the request for interim release on June 12, but the ICC prosecutor maintains that no adequate safeguards have been presented to prevent further interference with justice.

The ICC is currently investigating Duterte over alleged crimes against humanity in connection with thousands of deaths during the Philippine “war on drugs” under his administration. A decision from the ICC Chamber on the interim release request is still pending.

  1. This is a very good decision and proves that justice for duterte’s victims are rolling, and all his potential would be victims if temporarily released will be saved. Evil shouldn’t be freed for all he will do is only evil….
