Supreme Court’s Decision In Marcos Burial Not Yet Final, Veteran Lawyer Says

Supreme Court’s decision on allowing Marcos burial at the “Libingan ng mga Bayani” was not yet final, Veteran Lawyer Romulo Macalintal says.

On Wednesday (November 16, 2016), Macalintal said in a statement that the executive department should respect the Supreme Court’s decision on Marcos hero’s burial in Taguig City until it becomes final.

The executive department’s disapproval to implement the motion for reconsideration shows disrespect, according to Macalintal. Also, the case of Samad vs Comelec on 1993 was metioned by the lawyer saying that SC decision to issue a temporary restraining order (TRO) but the Court held the lifting of TRO could be the subject of a motion for reconsideration.

Macalintal explained that the Supreme Court’s decision is not yet final and executory. The decision of the court must be respected and wait until they release their final decision because any attempt to implement the said decision could be subject to administrative and criminal charges.
